Please read these Terms and Conditions ("Terms") carefully before using the ParkEasy AI WhatsApp-based service ("Service") operated by ParkEasy AI ("us," "we," or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all users, including Parking Owners and their authorized Attendants, who use the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
1. Service Description
ParkEasy AI provides a Software as a Service (SaaS) platform that allows parking lot owners and their attendants to manage their parking operations via WhatsApp. The service includes logging vehicle entries and exits, calculating parking fees, managing monthly passes, and generating business reports.
2. User Accounts & Responsibilities
- Account Creation: To use our Service, a Parking Owner must register with us and provide accurate and complete information, including their name, WhatsApp number, and details of their authorized attendant(s).
- User Conduct: You are responsible for all activity that occurs under your account. You agree not to use the Service for any illegal or unauthorized purpose.
- Data Accuracy: You are solely responsible for the accuracy of the information you input into the Service (e.g., vehicle numbers). ParkEasy AI is not liable for any issues arising from incorrect data entry.
- Security: You are responsible for safeguarding your WhatsApp account and for any activities or actions under it.
3. Subscriptions and Payment
- Fees: The Service is billed on a subscription basis ("Subscription"). You will be billed in advance on a recurring, periodic basis (e.g., monthly or annually).
- Payment: All subscription payments are processed through a secure third-party payment gateway.
- Renewal: Your Subscription will automatically renew at the end of each billing cycle unless you cancel it.
- Fee Changes: We reserve the right to modify the subscription fees at any time. Any fee change will become effective at the end of the then-current billing cycle. We will provide you with reasonable prior notice of any change in subscription fees.
4. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of ParkEasy AI and its licensors. The Service is protected by copyright, trademark, and other laws of India. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
5. Limitation of Liability
In no event shall ParkEasy AI, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any unauthorized access to or use of our servers and/or any and all personal information stored therein; (iii) any interruption or cessation of transmission to or from the Service; (iv) any bugs, viruses, trojan horses, or the like which may be transmitted to or through our Service by any third party.
6. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Gujarat, India, without regard to its conflict of law provisions. Any disputes arising out of these Terms will be subject to the exclusive jurisdiction of the courts located in Ahmedabad, Gujarat.
8. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
